Pirate bay and mininova are not really Torrent search engines... they are sites which HOST TORRENTS with a search bar implemented into their site.

A Torrent search engine is quite different... It&#039;s a website which searches sites which HOST TORRENTS.... Big Difference. A good example is Qtorrents.com 

Qtorrents.com = Torrent Search Engine
Mininova.org  = Torrent Hosting site

Big difference here... and yes, I actually agree with mashable. Sites like Qtorrents.com and Google are both the same in respects to how fetching of other sites information is concerned. In this case a site like Qtorrents.com is perfectly legal because they do not host any torrents. They are only a search engine much like Google and Yahoo.

		<description>I agree with you completely. Mashable is just trying to rank the hits on this one. Any search engine just archives pages and not trackers. I&#039;m in support of both what Pirate Bay and Google are doing. if they want to prosecute people then prosecute those that are profiting or distributing it in masses on server farms.</description>

They are just linking to the torrents. Torrents are shard by users. If they want to stop. they start stoping all users sharing which is virtually impossible.

I think that you mixed up things here. Trackers (a music file component) was never hosted by pirate bay but they are a bittorrent tracker, which just means that they connect users with each other. It is nothing illegal by itself. They never hosted any illegal material and that is what makes this case so complicated. They never had anything than links and indexes and provided the mean to connect users (downloaders) with each other. The illegal material was somewhere else and Pirate Bay just pointed to it with links (torrent files) that other people uploaded. The tracker part is just there to make the computers to connect in the initial phase.

A torrent file by itself is not more illegal than a link is it? A torrent searcher is only different from a general searcher by technical means.
It is not clear to me what the Pirate Bay is doing, that Google does not do, but in a much larger scale. They both host links.
